Legal costs quite often are the determining factor in a purchaser
choosing a lawyer. This in many respects is very unfortunate as
quite often there is no correlation between costs and the quality
of service a purchaser is provided.
It is our view that a purchaser should pay a reasonable fee for
quality service.
Under the old land titles system, a purchaser could have been told
the legal costs up front to the dollar if the purchase price and
mortgage amounts were known.
Unfortunately, the vendor's title will determine the purchaser's
legal costs and the title is not usually searched until the lawyer
is hired. The factors that play a role are the number of titles
(lots) being transferred, are minerals included and how many tenants
in common own the property.
Even though this seems confusing, it is our experience that the
total costs of a normal residential purchase in Regina has ranged
between $850 and $1100 including disbursements and taxes on the
fees and disbursements.
